What Happens After You Report PPP Loan Abuse
What happens to the business that committed PPP loan abuse?
The SBA will investigate every report of PPP loan fraud that it receives. If the SBA finds evidence of fraud, it will refer the case to the Department of Justice (DOJ) for prosecution.
The DOJ will then determine whether or not to bring charges against the business. If charges are brought, the business will have to go to court to defend itself.
If the business is convicted of committing PPP loan fraud, it will be required to repay the full amount of the loan, plus interest and fees. The business may also be fined up to $1 million and its owners may be subject to prison time.
What happens to the employees of the business that committed PPP loan abuse?
If your business has committed PPP loan abuse, the employees of the business may be subject to termination, disciplinary action, or other employment-related consequences. Termination may be warranted if the employee engaged in PPP loan abuse knowingly or recklessly, or if the employee had a duty to prevent or report the PPP loan abuse and failed to do so. Disciplinary action may be warranted if the employee negligently engaged in PPP loan abuse or if the employee had a duty to prevent or report the PPP loan abuse and failed to do so. Other employment-related consequences may include, but are not limited to, demotion, reassignment, loss of privileges, and salary decreases.
