What happens after you report PPP loan fraud

The investigation process

Once you’ve filed a report, the SBA will investigate the matter. If the SBA finds evidence of fraud, it will refer the case to the Department of Justice (DOJ) for criminal prosecution.

The DOJ will then decide whether or not to pursue the case. If it does, the business owner will be contacted by an investigator and asked to provide information and documents related to the loan. The DOJ may also subpoena records from banks and other third parties.

After conducting its investigation, the DOJ will decide whether or not to bring charges against the business owner. If charges are filed, the case will go to trial. If the business owner is convicted, they could face fines, imprisonment, or both.

If the SBA determines that your loan was obtained fraudulently, you will be notified in writing and given the opportunity to repay the loan in full. If you are unable to repay the loan, the SBA will take administrative action to recover the funds. This may include referral to the Department of Justice for criminal prosecution.
